The Arrears Formula (How to Calculate)

Arrears are simply the difference between what you should have been paid (New Salary) and what you were actually paid (Old Salary) during the delay period.

The “Zero DA” Factor:

Tax Warning: Don’t Lose 30% to TDS

Receiving ₹2 Lakhs as a lump sum arrears in one month will spike your income, potentially pushing you into the 30% tax slab. However, the Income Tax Act provides relief.

Section 89(1) Relief (Mandatory)

You can claim relief under Section 89(1), which allows you to spread the tax liability of the arrears over the years they actually belong to (e.g., 2026), rather than paying tax on the entire amount in the year of receipt (e.g., 2027).

Requirement: You MUST file Form 10E on the Income Tax Portal before filing your ITR. If Form 10E is not filed, the Income Tax Department will send a notice for the unpaid tax.

Will Allowances Get Arrears?

This is a common confusion. The rules for arrears differ for Basic Pay vs Allowances:

  • Basic Pay & DA: Arrears are Paid (Retrospective effect).
  • HRA (House Rent Allowance): Arrears are NOT Paid. HRA rates are usually revised only from the date of the official notification (Prospectively).
  • Transport Allowance (TPTA): Adjusted based on the new DA rate. Since DA drops to 0%, TPTA arrears are often negligible or nil.
Will I get interest on late arrears payment?

No. The government generally does not pay interest on Pay Commission arrears, even if the payment is delayed by 18-24 months.

Is NPS deducted from arrears?

Yes. 10% of the arrear amount (Basic + DA component) is mandatorily deducted for the National Pension System (NPS). The government will also contribute its 14% share for the arrears period.

Can I refuse arrears to avoid tax?

No. Arrears are part of your salary income. You cannot refuse them, but you can legally reduce the tax burden by filing Form 10E under Section 89(1).
