Leave Not Due (LND) Rules 2026: Borrow 360 Days HPL & Refund Risk

Life is unpredictable. Sometimes, a serious illness strikes when an employee has exhausted all their Earned Leave (EL) and Half Pay Leave (HPL). In such cases, the government allows you to draw Leave Not Due (LND). It is basically an advance credit of HPL.

Conditions for Granting LND

LND is not a right; it is granted under specific conditions:

1. No Balance: You must have Zero HPL in your account.
2. Medical Grounds: It is granted ONLY on medical certification (except for maternity cases).
3. Return Probability: The authority must be satisfied that you will return to duty and earn back the borrowed leave.
4. Limit: Maximum 360 Days in the entire service.

The Salary Trap: Refund Rule

This is the most dangerous part of LND. Since you are borrowing from the future, you are in “Debt” to the government.

LND vs. EOL (Extra Ordinary Leave)

Why choose LND over EOL?

• LND: You get Half Pay (Basic/2 + DA). It counts as Qualifying Service for Pension and Increment.
• EOL: You get No Pay. It may NOT count for Pension/Increment (unless on medical grounds).
