Railway Family Pension 2026: New Rules for ‘Missing’ Employees (FIR & Forms)

  • Status: New Forms Notified
  • Authority: Railway Board (RBE 07/2026)
  • Required Proof: Police Report (FIR) & Format 4
  • Benefit: Provisional Pension without 7-Year Wait

What Changed: Streamlined Process

In the newly notified Railway Services (Pension) Rules, 2026, the Railway Board has codified the procedure for granting Family Pension in cases where a Railway servant goes missing. Previously, families often faced harassment and were asked to wait for 7 years (Civil Death declaration). The new rules explicitly include “Report lodged with Police” and “Report received from Police” as standard documents in the Claim Form checklist, ensuring faster processing of Provisional Pension.

The New Protocol: Documents Required

To claim Family Pension immediately after an employee goes missing, the family must submit the following documents as per the 2026 Notification:

✔ Mandatory Documents

  • 1. FIR Copy: “Report lodged by the family with the police” (Item 4).
  • 2. Police Report: “Report received by the family from the police” confirming the employee is not yet traced (Item 5).
  • 3. Indemnity Bond: An undertaking to refund the amount if the employee reappears.

✖ Key Relief

  • No Court Decree Needed: You do NOT need to wait for a court to declare the person “dead” (which takes 7 years) to start the Provisional Pension.

Pension Calculation (Missing Case)

The family is eligible for benefits based on the Last Pay Drawn by the missing employee.

Component Rate Example (Basic Pay ₹50,000)
Family Pension (Enhanced) 50% of Basic Pay ₹25,000 + DA
Family Pension (Normal) 30% of Basic Pay ₹15,000 + DA
Gratuity (DCRG) Based on Service Paid after Police Report
Leave Encashment Based on Balance Paid Immediately

Frequently Asked Questions

When does the Family Pension start in missing cases?

Family Pension usually starts from the date the FIR was lodged, provided the Police Report confirms the person is untraceable. The administration processes this after a mandatory waiting period (often 6 months) to see if the person returns, but this varies by specific case instructions.

What happens if the employee returns?

If the missing employee reappears, the family pension stops immediately. The employee resumes service (if eligible) or pension. The amount paid to the family is adjusted against the employee’s future salary or pension entitlements as per the Indemnity Bond.
